Can you sue a trucking company’s insurer directly?
A 2024 law narrowed Georgia’s direct-action rules. By Talal Perez Ghosheh · October 2026

Georgia used to let injured people name a motor carrier’s insurer as a defendant in more cases. Since July 2024, that’s generally limited to situations like the carrier’s bankruptcy or when it can’t be served.
What it means
The insurer still pays covered claims; it just usually isn’t named in the lawsuit. Identifying every policy remains essential.
